Service description

SPARK Capacity Assessment is a developmental capacity-assessment product operated by Defiant Solutions LLC. The service provides AI-scored capacity assessments and report cards intended for individual self-knowledge and team development.

Use restrictions

By using SPARK, you agree that:

You will not use SPARK scores for hiring, firing, promotion, performance review, or compensation decisions.
You will not represent SPARK scores as a validated hiring credential.
You will not attempt to reverse-engineer the scoring engine or rubrics for adversarial purposes.
You will not submit responses on behalf of someone other than yourself.
You will not use generative AI tools to draft, polish, or otherwise substantially generate the prose of your responses. The assessment is meant to measure your own reasoning; submissions found to have been AI-generated may be flagged for human review, voided, or excluded from any subsequent calibration analysis.

Payment

Payments are processed by Stripe. Access codes are issued after successful payment. Each code grants one full six-dimension assessment.

Refunds

If you have not yet redeemed your access code, we will issue a full refund within 30 days of purchase. Email support@spark-assessment.com with your purchase receipt.

Intellectual property

The SPARK rubrics, scoring engine, candidate-facing surface, and brand identity are owned by Defiant Solutions LLC. Your written responses to the assessment scenarios remain yours; Defiant Solutions has a limited right to use them for service operation, your report delivery, and aggregate calibration analysis as described in the privacy policy.

Disclaimer of warranty

SPARK is provided as-is. We do not warrant that scores are predictive of any particular real-world outcome. The product is positioned as developmental feedback; using it for any other purpose is at your own risk.

Limitation of liability

To the extent permitted by law, Defiant Solutions LLC's liability for any claim arising from your use of SPARK is limited to the amount you paid for the service.

Governing law

These terms are governed by the laws of the State of California, USA.
